Welcome to Bullish Coffee NFT platform. These Terms of Service govern your use of our platform and the minting of NFTs on the XRP Ledger (XRPL). By accessing or using our platform, you agree to be bound by these terms.

Our platform allows users to mint, buy, sell, and trade non-fungible tokens (NFTs) on the XRP Ledger. We provide a marketplace for digital assets related to coffee, community, and blockchain technology.

If you do not agree with any part of these terms, you may not access or use our platform.

When you mint an NFT on our platform, you are purchasing a non-fungible token on the XRP Ledger that represents ownership of a digital asset. The NFT is stored on the XRPL and ownership is determined by the wallet address that holds the NFT.

Ownership of an NFT does not grant you ownership of the underlying intellectual property rights to the content linked to the NFT, unless explicitly stated otherwise.

You understand that blockchain transactions are irreversible and we cannot recover NFTs sent to incorrect addresses or lost due to loss of private keys.

By minting an NFT, you receive a license to use, copy, display, and create derivative works based on the content linked to the NFT for personal, non-commercial use. This license is valid as long as you own the NFT.

For Bullish Coffee Founder, Platinum, and Genesis NFTs, you also receive additional rights and benefits as specified in the NFT description, which may include:

• Access to exclusive community events
• Voting rights on platform development
• Revenue sharing from platform fees
• Early access to new features and NFT drops

The specific rights and benefits for each tier are detailed in the NFT description at the time of purchase.

All transactions on our platform require payment in XRP. The price for minting an NFT is displayed before confirmation. In addition to our fees, you may be subject to network fees (gas fees) for transactions on the XRPL.

Our platform charges the following fees:

• Minting Fee: Varies by NFT tier
• Marketplace Fee: 2.5% of transaction value for secondary sales
• Withdrawal Fee: Network gas fees only

All fees are subject to change. We will provide notice of any fee changes through our platform.

You understand that blockchain technology and NFTs are emerging technologies that carry financial risk. We do not guarantee the value or future tradability of any NFT. You accept all risks associated with the purchase of NFTs.

These risks include, but are not limited to:

• Price volatility of XRP and NFTs
• Regulatory changes affecting blockchain assets
• Technical vulnerabilities in blockchain networks
• Loss of access due to lost private keys
• Changes in platform functionality or availability

You should only purchase NFTs with funds that you can afford to lose. We recommend conducting your own research before making any purchases.

You agree not to use our platform for any illegal activities or in any manner that could damage, disable, overburden, or impair our services.

Prohibited activities include:

• Creating, uploading, or trading content that infringes on intellectual property rights
• Using the platform for money laundering or financing illegal activities
• Attempting to manipulate markets or prices
• Harassing other users or engaging in abusive behavior
• Using automated systems or bots without our permission
• Attempting to gain unauthorized access to other users' accounts

Violation of these rules may result in termination of your access to the platform.

All content on our platform, including but not limited to text, graphics, logos, and software, is the property of Bullish Coffee or its content suppliers and is protected by international copyright laws.

By using our platform, you agree not to copy, modify, distribute, or create derivative works based on our platform content without our express permission.

We reserve the right to terminate or suspend your access to our platform at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the platform will immediately cease. However, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Our platform and services are provided “as is” without any warranties, expressed or implied. We do not guarantee that our platform will be secure or error-free.

We make no warranties or representations about the accuracy or completeness of the content on our platform or the content of any websites linked to our platform.

In no event shall Bullish Coffee be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our liability is limited to the maximum extent permitted by law. In jurisdictions where limitation of liability for certain damages is not permitted, our liability shall be limited to the extent permitted by law.

We reserve the right to modify these terms at any time. If we make changes, we will provide notice of such changes, such as by sending an email, providing a notice through our platform, or updating the date at the top of these terms.

Your continued use of our platform following the posting of revised Terms means that you accept and agree to the changes.

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bullish Coffee is established, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
